FEE RATES AND TIME LIMITS FOR FEE REMITTANCE



By virtue of the Decree of the Minister of Agriculture and Rural Development of February 17, 2004 (OJ of 2004 No 60, item 567; as amended by OJ of 2015, item 2166), the fee rates for Plant Breeders' Rights protection (PBR) in Poland are as follows:

1. Plant groups

Group I

  • Maize, Oat (incl. Red Oat), Potato, Spring Barley, Sugar Beet, Wheat, Winter Oilseed Rape, Winter Rye, Winter Triticale;

Group II

  • Durum Wheat, Italian Ryegrass, Lucerne, Perennial Ryegrass, Red Clover, Sand Lucerne, Spring Oilseed Rape, Westerwold Ryegrass, Winter Barley;

Group III

  • agricultural plants: Canary Grass, Cocksfoot, Festulolium, Field Bean, Field Pea, Flax/Linseed, Fodder Beet, Fodder Galega, Hemp, Meadow Fescue, Meadow Foxtail, Poppy, Red Fescue, Rough-Stalked Meadowgrass, Small Naked Oat (Hulless Oat), Smooth-Stalked Meadowgrass, Spelt Wheat, Spring Triticale, Sunflower, Swamp Meadowgrass, Timothy, Turnip Rape, White Clover, Wood Meadowgrass,

  • other plants, not included in group VI, which varieties are not subject to national listing.


2. Time limits for fee remittance


  • Application fee shall be remitted jointly with an application.
  • Examination fee for the first and each consecutive vegetation season, during which DUS tests are carried out should be remitted within 30 days from the date of delivery of the notification on the beginning of testing.
  • Issue fee (grant of PBR) shall be remitted within 60 days from the date of the decision on grant of PBR delivery.
  • Maintenance fee should be remitted
    • for the first calendar year - within 60 days from the date of delivery of the decision on grant of PBR
    • for the second and each subsequent calendar year - by the end of June.

If DUS testing is carried out both for the purpose of national listing and grant of PBR - only one fee for DUS testing is in force.

4.

Fee for the DUS testing of a hybrid variety, regardless of its structure, is a double amount of the relevant fee, if the components of this variety are examined.

5.

Maintenance fee shall not be remitted for a given calendar year, if a variety has been withdrawn from the PBR in the first half-year.


Fees shall be remitted on the following bank account, at the same time giving the title of payment as well as the species and variety concerned is required.
