FEE RATES AND TIME LIMITS FOR FEE REMITTANCE


By virtue of the Decree of the Minister of Agriculture and Rural Development of December 15, 2015 on fees connected with variety examinations and national listing (NLI) (OJ of 2015, item 2169), the fee rates are as follows:

  2. Time limits for fee remittance

    • Application fee shall be remitted jointly with an application.

    • Examination fee for the first and each consecutive vegetation season, during which DUS and VCU tests are carried out should be remitted within 30 days from the date of delivery of the notification on the beginning of testing.

    • Issue (award) fee (for an entry in NLI) shall be remitted within 60 days from the date of the delivery of the decision on addition of a variety to NLI.

    • Maintenance fee should be remitted:

      • for the first calendar year within 60 days from the date of delivery of the decision on addition of a variety to NLI

      • for each subsequent calendar year following the year, in which the decision on addition of a variety to NLI was issued, by the end of June.

    • Fee for taking over of the report on technical examination (DUS) shall be remitted within 60 days from the date of its sending.

  3. Manner of fee remittance

    • If DUS testing is carried out for the purpose of addition to NLI and grant of PBR - only one fee for DUS testing is in force.

    • If a variety is applied for NLI for different kinds of use, a fee for VCU examination should be remitted separately for every kind of VCU assessment.

    • Fee for the DUS testing of a hybrid variety, regardless of its structure, is a double amount of the relevant fee, if the components of this variety are examined.

    • Annual maintenance fee in case of varieties maintained by several maintainers shall remit each of them.

    • Maintenance fee shall not be remitted:

      • for a given calendar year, if a variety has been deleted from the NLI in the first half-year;

      • for a first calendar year, if a variety has been deleted from the NLI, on the maintainer's request, before deadline for payment.

    • In case of conservation and amateur varieties as well as varieties applied/listed on fruit list B (having an officially recognized description), there is no charge.
